The Employees' State Insurance Act, 1948 establishes a social security system for employees in India, administered by the Employees' State Insurance Corporation (ESIC). The scheme provides medical care and financial protection to employees and their dependents in cases of sickness, maternity, employment injury, disability, and death.

1. Coverage and Eligibility Criteria

a) Applicability of the Act

  • Factories and establishments employing 10 or more employees (in most states).
  • Shops, hotels, restaurants, cinemas, transport undertakings, educational and medical institutions in notified areas.

b) Employee Eligibility

  • Employees earning up to ₹21,000/month (₹25,000 for persons with disabilities).
  • Working in an ESI-covered establishment.
  • Contribution by both employer and employee.

c) Contribution

  • Employer: 3.25% of wages
  • Employee: 0.75% of wages

Employees earning up to ₹176/day are exempt from employee contribution.

d) Contribution & Benefit Period
